These Terms and Conditions govern your use of Martech.Network (“the Platform”), operated by David Garcia (“we”, “us”, “our”). By accessing or using the Platform in any capacity, you agree to be bound by these terms. If you do not agree, please do not use the Platform.
These Terms are governed by the laws of England and Wales.
1. About the Platform
Martech.Network is a community publication platform for marketing technology professionals. It provides access to editorial content, community resources, and author publishing tools. The Platform is accessible at martech.network and its subdomains.
2. Who These Terms Apply To
These Terms apply to all users of the Platform, including:
- Visitors — anyone browsing the Platform without a registered account
- Registered Users — anyone who has created an account on the Platform
- Authors — registered users who have been accepted into the author programme and publish content on the Platform
3. Accounts and Registration
To access certain features of the Platform, you must register for an account. By registering you confirm that:
- The information you provide is accurate and complete
- You are at least 18 years of age
- You will keep your account credentials secure and not share them with others
- You are responsible for all activity that occurs under your account
We reserve the right to suspend or terminate any account that we reasonably believe has provided false information, violated these Terms, or is being used in a manner that is harmful to the Platform or its community.
4. Community Conduct
All users of the Platform, whether visitors, registered users, or authors, are expected to engage respectfully and in good faith. The following are strictly prohibited:
- Harassment, abuse, or intimidation of any other user or author
- Posting or sharing content that is defamatory, discriminatory, or unlawful
- Spamming, phishing, or any form of deceptive communication
- Attempting to gain unauthorised access to any part of the Platform
- Any conduct that disrupts or damages the Platform or its community
We reserve the right to remove content and suspend or terminate accounts that violate these standards without prior notice.
5. Author Programme
Authors are users who have been accepted through the Martech.Network author application process and are granted publishing rights on the Platform.
Eligibility To become an author you must submit an application and be approved by the Martech.Network editorial team. Acceptance is at our sole discretion.
Author Obligations By publishing on the Platform, authors agree to:
- Comply with the Martech.Network Publication Guidelines at all times
- Publish only original content that does not infringe the intellectual property rights of any third party
- Take full responsibility for the accuracy and legality of their published content
- Not publish content that is promotional, sponsored, or commercially motivated without prior written approval from Martech.Network
Account Progression Authors begin with Contributor status for their first three published posts, which are subject to editorial review. Upon successful publication of three reviewed posts, authors are upgraded to Author status with full publishing autonomy.
Termination of Author Status We reserve the right to suspend or permanently revoke author status at any time if an author is found to have violated these Terms or the Publication Guidelines. Where possible we will provide notice and an opportunity to address the issue, however we reserve the right to act immediately where the violation is serious.
6. Intellectual Property
Author Content Authors retain full ownership of the content they publish on the Platform. By submitting content for publication, authors grant Martech.Network a non-exclusive, royalty-free, worldwide licence to publish, display, and distribute that content on the Platform and its associated channels.
If an author’s account is terminated or an author requests removal of their content, we will make reasonable efforts to remove the content from the Platform within a reasonable timeframe.
Platform Content All other content on the Platform, including the Martech.Network brand, logo, design, and non-author editorial content, is the property of Martech.Network and may not be reproduced, distributed, or used without prior written permission.
The Martech.Network Associate Badge The badge issued to accepted authors is a digital credential licensed for personal use. It may be displayed on LinkedIn, email signatures, and personal portfolios. It may not be altered, resold, or used in any way that misrepresents your relationship with Martech.Network. Badge access may be revoked if author status is terminated.
7. Content Liability
Author Responsibility Authors are solely responsible for the content they publish on the Platform. Martech.Network does not verify the accuracy, completeness, or legality of author content and accepts no liability for any loss or damage arising from reliance on author published content.
Platform Liability To the fullest extent permitted by law, Martech.Network shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform, including but not limited to loss of data, loss of revenue, or reputational damage.
We do not guarantee that the Platform will be available at all times, error-free, or free from viruses or other harmful components. Access to the Platform may be suspended or interrupted at any time without notice.
8. Third Party Links and Content
The Platform may contain links to third party websites and resources. These links are provided for convenience only. Martech.Network has no control over the content of third party sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them.
9. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform you consent to the collection and use of your data as described in the Privacy Policy.
10. Termination
We reserve the right to suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Reasons for termination may include but are not limited to violation of these Terms, conduct harmful to the community, or prolonged inactivity.
You may also delete your account at any time by contacting us. Upon deletion we will remove your personal data in accordance with our Privacy Policy.
11. Changes to These Terms
We reserve the right to update or modify these Terms at any time. Where changes are material, we will provide at least 30 days notice before the changes take effect, either by email to your registered address or by a prominent notice on the Platform. Your continued use of the Platform after the notice period constitutes acceptance of the updated Terms.
We encourage you to review these Terms periodically.
12. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
